ORDER REQUIREMENTS
To open a new account, there is a minimum order requirement of $1000.00 CAD or US. Reorders for open accounts carry no minimum. In order to keep your account open, a minimum annual purchase of $500 is required.

BACK ORDERS
Back orders over $100.00 will remain in effect unless automatically cancelled by the terms of the purchase order. Pink & Brown is not responsible for any pricing or application errors on P.O.’s whether made by a representative of Pink & Brown or by the customer.

CANCELLED ORDERS
Cancelled, refused or returned orders are subject to a 25% restocking fee. This balance will be invoiced to the customer’s account and must be paid before any further orders are shipped. Freight charges for unclaimed orders will be charged to the customer and must be paid in addition to the new freight amount if the order is re-shipped. Alternatively if the order is not re-shipped, the charge will be posted to the customer’s account for payment. Pink & Brown must ship by the cancel date on the P.O. for it to remain valid, but is permitted a 5 business day leeway after the cancel date for the goods to arrive at the customer’s place of business. Cancel dates requested by the customer will only be accepted if they fall on or after the delivery offered for that particular item by Pink & Brown. Special or custom orders may not be cancelled or refused for any reason.

If a manufacturing delay is foreseen, Pink & Brown will notify the customer as soon as information is available. A 2-week grace period on these orders will be permitted in addition to the cancel date in this case unless other arrangements have been made. Pink & Brown shall in no way be held liable for failure to produce any item or order for any reason including forces of nature, acts of government (local or foreign), labor disputes, material shortage, transportation problems etc… Pink & Brown reserves the right to terminate any purchase order at its discretion.

PAYMENT
In order to keep our prices competitive and to offer excellent margins to our retail partners, PINK & BROWN DOES NOT OFFER CREDIT TERMS. All domestic orders (Canada & USA) will be shipped prepaid VISA or Mastercard or company cheque in addition to debit (Interac) if at our place of business. Once payment has been received and cleared, the shipment will be released. Any payments made by VISA or MasterCard must accompany our signed credit card authorization form including a photocopy of the front and back of the card as well as a valid piece of government issued ID such as a driver’s license. In most cases we will only be able to ship to the address on file with the credit card company.

All International orders including distributors (outside of Canada and USA), require an irrevocable letter of credit at time of order placement or a 50% non refundable deposit at time of order placement with the balance due prior to shipment from either our factory, agent or warehouse.

There is a $30.00 service charge on all returned checks (NSF). A replacement certified check must be received by Pink & Brown at its head office in Montreal within 5 business days of notice. If an un-certified replacement check is received, deposited and also returned NSF, the account will automatically be put into collection with an outside collection agency or through alternate legal channels with an additional administration and collection charge of 30%. Any customer who has 2 NSFs on their account will be shipped strictly on a prepaid certified cheque or money order basis once their account is again NIL.

All payments are to be made to the order of “Pink & Brown”.

TAXES
All orders shipped within Canada are subject to 5% GST. Orders shipped within the province of Quebec are also subject to 7.5% PST.

CLAIMS & RETURNS
If shipped back to Pink & Brown, returns or claims for any reason will be refused if not accompanied by a valid R.A number marked on the outside of the carton issued by Pink & Brown’s head office in Montreal, Canada (not by a sales rep or other). Please contact Pink & Brown customer service to discuss your situation. R.A numbers are only valid for the one shipment in question. Items will only be accepted as returns if shipped in the exact condition they were received and in original packaging. If the original packaging has been compromised, it is up to the customer to provide proper and secure packaging so that the item may be properly returned.

Any special or custom orders are not eligible for returns under any circumstance.

All claims of visible damage, shortages or surpluses must be written on the delivery slip before the driver leaves. Any concealed damages must be reported immediately after opening the shipment within a maximum 24-hour period so that a claim may be filed on the customer’s behalf with the freight or courier company. Once a claim has been filed, in most cases the freight or courier company will require that the customer keep possession of the damaged merchandise until the claim is settled. It will be at the sole discretion of the freight or courier company to determine if the claim is settled or denied. Pink & Brown will in no way be held liable for merchandise once it has left its warehouse in Montreal, Canada.

MANUFACTURING DEFECTS
Although we take pride in our quality control, we are not immune to the occasional un-noticed manufacturing defect. Any manufacturing defect must be reported within 5 days of receipt of goods. In those rare and exceptional cases, Pink & Brown will work in the customer’s best interest to ensure timely delivery of a replacement if available or a credit or discount. Any manufacturing defects not claimed within the 5 day period will not be considered as the item in question will have had excessive opportunity of further or other damage.

SHIPPING & HANDLING
All Canadian and US orders are shipped FOB Pink & Brown’s warehouse in Montreal, Canada by dedicated truck freight carriers or by fed ex ground unless otherwise specified by the customer. International orders will be shipped VIA the forwarding agent of the customer’s choice FOB our warehouse in Montreal, Canada or in larger quantities FOB our 3rd party distribution point near our factories worldwide. If a customer wishes to designate an alternate carrier, Pink & Brown must be advised at time of order placement by providing written details by e-mail or fax including courier or freight forwarder name, telephone, contact, and prepaid account number to ensure that shipping charges can be accurately be billed to the correct party.

WHITE GLOVE DELIVERY
In specific cases when an item is too fragile or heavy to ship via conventional freight, we offer a white glove delivery service to your place of business or directly to your customer’s home or business. This service includes a scheduled appointment for delivery with a minimum of 1 driver and 1 helper. Items may be delivered directly into the home or business, assembled if required and all unnecessary packaging and wrapping materials removed. White glove service usually takes a day or two longer and carries a surcharge.
